1. About the Game
The Game is a fictional, satirical strategy simulation, provided by Damian Slaczka ("we", "us"). It depicts invented companies and exaggerated weather events for entertainment. It is not a weather forecast, a prediction, a model of real disasters, or advice of any kind, and it does not make light of, or encourage, any real event or harm to real people. Never rely on the Game for any real-world safety decision.
2. Accounts
- You can play without an account. An account lets you sync your game and appear on the leaderboard.
- You must be at least 13 years old (or the age of digital consent where you live) to create an account.
- Give accurate information, keep your password secret, and tell us if you think your account has been misused. You're responsible for activity on your account.
- One person, one account. Don't sell, trade or share accounts.
- You can delete your account at any time from the Account page.
3. Your licence to play
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial entertainment, subject to these Terms. We own, or license, everything in the Service, including the code, art, music, text and the name "Acts of God, Inc." You may not copy, modify, reverse engineer (except where the law allows), resell or build commercial products from the Service, or remove any notices.
4. Fair play and conduct
The leaderboard is only fun if it's fair and friendly. You agree not to:
- cheat, edit or forge saves or result codes, exploit bugs to gain rank, or submit scores you did not earn;
- choose a display name that is offensive, hateful, sexual, harassing, impersonates someone, or includes personal information or advertising;
- use bots, scripts or automation against the Service, or probe, overload or try to break its security;
- do anything unlawful, or anything that harms other players or the Service.
Use the ⚑ button on the leaderboard to report a name or score. We may remove names, scores or content, reset leaderboard entries, and suspend or terminate accounts that break these rules, without notice where needed.
5. Your content
Your display name, scores and result codes are "your content". You keep ownership of it, and you give us a worldwide, royalty-free licence to host, display and use it for running the Service (for example showing it on the leaderboard). You promise you have the right to submit it.
6. Cost
The Game is free to play and has no in-app purchases or ads. If that ever changes, we'll tell you clearly before you're charged and the iOS app will follow Apple's rules.
7. Availability and changes
We work hard to keep the Service running but it's provided as a hobby-scale online service and may be unavailable, updated, changed or discontinued at times. Cloud saves are a convenience: keep your own backup with Settings → Save data in the Game if your progress matters to you. We may change the Game's balance, content and features, which may change or reset leaderboard standings.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation, to the fullest extent the law allows.
9. Limit of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost progress, data, profits or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the greater of US$50 or the amount you paid us for the Service in the past 12 months (which, for a free service, is nothing). Nothing here limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud.
10. Ending things
You may stop using the Service at any time and delete your account. We may suspend or end your access if you break these Terms or the law, or if we discontinue the Service. Sections that by their nature should survive (ownership, disclaimers, liability, governing law) will survive.
11. Governing law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law rules, and courts there have jurisdiction, except that you keep any mandatory consumer rights you have under the laws of the place you live.
12. Additional terms for the iOS app
These apply if you use our app on an Apple device, in addition to the above.
- Acknowledgement. These Terms are between you and Damian Slaczka, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
- Scope of licence. The licence is limited to use on Apple-branded products you own or control, as permitted by the Apple Media Services Terms and Conditions.
- Maintenance and support. We, not Apple, are responsible for support and maintenance. See our support page. Apple has no obligation to provide any.
- Warranty. If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund any purchase price (the app is free, so none); to the extent allowed by law Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to meet a warranty are our responsibility.
- Product claims. We, not Apple, are responsible for addressing your or any third party's claims relating to the app, including product liability, legal or regulatory compliance, and consumer protection or privacy claims.
- Intellectual property. If a third party claims the app infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints or claims: Damian Slaczka, info@actsofgodinc.com.
- Third-party terms. You must comply with applicable third-party terms (for example your wireless data service agreement) when using the app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
13. Changes to these Terms
We may update these Terms from time to time. If a change matters we'll update the date above and, where appropriate, tell you in the Game. Continuing to use the Service after a change means you accept it.
